Jumhur Sebut Semua Orang Bisa Dijerat Pasal 15 KUHP seperti Dirinya, Terkait Omnibus Law UU Cipta Kerja

Jakarta, wartategas.com – Aktivis Kesatuan Aksi Menyelamatkan Indonesia (KAMI) Jumhur Hidayat menganggap semua orang bisa divonis bersalah di pengadilan dengan dijerat Pasal 15 KUHP.
Dia bicara demikian usai divonis bersalah terkait kasus penyebaran berita bohong tentang Omnibus Law Cipta Kerja oleh Pengadilan Negeri Jakarta Selatan. Dia dinyatakan bersalah karena menyiarkan kabar tidak lengkap sehingga menimbulkan keonaran.

“Jadi ada Pasal 15 itu semua orang bisa kena. Jadi seseorang menuliskan atau menyiarkan berita tidak lengkap atau berlebihan atau berpotensi menimbulkan keonaran,” kata Jumhur saat ditemui awak media pasca sidang putusan di PN Jaksel, Kamis (11/11).

Jumhur menegaskan bahwa setiap orang tidak bisa menulis sesuatu dengan lengkap dan panjang lebar di akun Twitter. Sebab, platform itu hanya menyediakan 150 kata dalam satu unggahan.

Oleh karena itu, jika ada orang yang mencuit di Twitter, bisa saja dikenakan pasal 15 KUHP seperti dirinya.

“Hanya 150 kata, pasal itu logikanya bisa kena kepada siapa saja,” ujar Jumhur.

Hal senada juga disampaikan kuasa hukum Jumhur, Oky Wiratama Siagian. Merujuk kasus Jumhur, dia menganggap semua orang jadi sangat mudah diproses hukum dengan Pasal 15 KUHP jika ada yang merasa dirugikan.

Dia mengatakan Pasal 15 KUHP berpotensi digugat ke Mahkamah konstitusi.

“Kalau ada orang yang resah dengan tulisan kita, maka itu bisa masuk Pasal 15, karena itu hanya dapat berpotensi dan itu kabar tidak lengkap,” kata Oky.

Oky mengatakan telah ada beberapa aktivis juga pernah disangkakan dengan pasal 15 KUHP. Mereka antara lain, pendiri rumah dokumenter audio visual Watchdoc, Dandhy Dwi Laksono dan Ravio Patra.

“Waktu itu tidak sampai persidangan kasusnya Dhandy Laksono dan Ravio dikenakan di kepolisian Pasal 14, Pasal 15 favorit banget pasal kayaknya lagi tren harus dicabut,” ujar Oky.

Sebelumnya, Majelis Hakim PN Jaksel memvonis Junhur dengan hukuman 10 bulan penjara.

Menurut Hakim, Jumhur terbukti secara sah dan meyakinkan telah melakukan tindak pidana karena menyiarkan kabar tidak lengkap mengenai UU Cipta Kerja.

“Menjatuhkan pidana oleh karena itu kepada Mohammad Jumhur Hidayat dengan pidana berupa penjara selama 10 bulan,” kata Hakim Hapsoro.

“Menetapkan terdakwa tidak ditahan,” tambah Hapsoro.
